Seller Agreement
This agreement sets out the obligations of anyone who lists a vehicle for sale on Carified. It forms part of our Terms of Service and must be accepted each time you publish a listing, or each time you send us a car to list for you.
The Key Points
- You accept this agreement each time you publish a listing.
- Disclosing defects and modifications is mandatory.
- Every required photo, current, and a genuine asking price.
- No stolen, statutory write-off or undisclosed-finance vehicles.
- Fees are in AUD. A fee change never affects a paid listing.
- Breaches can lead to suspension or a report to authorities.
These points help you scan. The full text in each section is what applies.
Introduction
Carified exists to make buying and selling used vehicles safer and more transparent for everyone in Australia. This Seller Agreement describes what we expect from you when you use the Platform as a seller — and what buyers can expect from you too.
By accepting this agreement (which you do by ticking the seller agreement checkbox each time you publish a listing), you acknowledge that you have read, understood, and agreed to be bound by everything set out below, as well as our Terms of Service and Privacy Policy.
If you send us a car through our Sell My Car form for our staff to list on your behalf, you accept this agreement when you send it, and it applies to that listing as if you had published it yourself.
Identity Verification
Sellers may complete identity verification to receive a verified badge on their profile and listings. Verification requires submitting a valid government-issued photo ID (e.g. driver’s licence or passport) and a selfie, which our team reviews directly.
If you complete verification, your verified identity is permanently associated with all listings you publish while that status is active. Attempting to circumvent or falsify verification — including by using another person’s identity — will result in immediate account termination and may be referred to law enforcement.
Dealerships are verified separately. A dealership needs a current dealer licence and an active ABN, which our team reviews before it can put cars on sale, and our Dealer Agreement applies to it as well as this one. A dealership’s ABN and licence are shown on its storefront. If its dealer status is revoked or its plan ends, its cars come off sale.
Private Sellers & Dealer Licensing
Personal listings are for private sellers selling their own cars. You must hold a motor dealer licence, and list as a dealer rather than a private seller, if:
- you buy or sell cars as a business, or regularly for profit; or
- you sell more cars in a 12-month period than your state or territory allows without a licence. In most states and territories that limit is reached at 4 or more cars in 12 months, but the rules differ, so check with your state or territory’s fair trading or consumer affairs regulator.
Unlicensed car dealing is against the law. If an account looks like it is being used for unlicensed dealing, we may ask you about it, limit how many cars you can list, or suspend the account.
Listing Requirements
Every listing must include:
- Accurate vehicle details: Make, model, year, odometer reading, and VIN must be correct, as must the variant if you provide one. Odometer readings must be taken at or near the time of listing.
- A genuine odometer reading: Winding back, tampering with, or misrepresenting a vehicle’s odometer is prohibited, and is an offence under Australian law. If the odometer has been replaced or corrected, the reading you give must be truthful and you must explain the change in the listing.
- Photos and videos: Every photo the listing wizard requires for your plan. For Free and Premium listings, that covers the exterior, the interior, and the engine bay, and Premium listings also require the walkaround and cold-start videos. Dealer listings require at least 12 photos of the car. Photos and videos must be current — not stock images or media taken from a previous listing.
- Asking price: Must reflect a genuine sale price. “Price on application” is not permitted.
- Finance owing: An automatic Personal Property Securities Register (PPSR) and vehicle history check is coming soon, but isn’t available yet — no listing, including Premium and Dealer listings, currently includes one. You must disclose any financial encumbrance you are aware of.
- Service history: Enter the vehicle’s known service history, or formally acknowledge that no documented service history exists. You may also upload supporting service records.
Mandatory Disclosure
Transparent disclosure is what sets Carified apart. You must complete the disclosure checklist for every listing. This is not optional.
Defects
You must disclose all known defects that materially affect the vehicle’s safety, roadworthiness, or value. This includes but is not limited to: mechanical faults, structural damage, body damage (including paint defects), electrical issues, and failed roadworthy items.
If you are not aware of any defects, you must formally acknowledge this in the listing. “Sold as-is” descriptions do not substitute for the disclosure checklist.
Modifications
All modifications from factory specification must be declared — including engine, suspension, braking, wheels, exhaust, electrical, and cosmetic modifications. Where a modification requires engineering certification, state in its description whether it has been certified.
Write-offs
You must truthfully disclose whether the vehicle has ever been recorded on a written-off vehicle register, whether as a repairable write-off or a statutory write-off. A repairable write-off can be listed once it has been repaired and re-registered as your state or territory requires; a statutory write-off can’t be listed at all (see Prohibited Listings).
Previous use
You must disclose in your listing description if, to the best of your knowledge, the vehicle has been used as a taxi, rideshare vehicle, emergency vehicle, hire car, or driver training vehicle at any point in its history.
Misleading or incomplete disclosure may constitute a breach of the Australian Consumer Law and could expose you to civil liability. Carified does not accept responsibility for loss arising from a seller’s failure to disclose.
Prohibited Listings
You must not list:
- Vehicles you do not own or do not have legal authority to sell.
- Stolen vehicles or vehicles with a cloned or altered VIN.
- Vehicles subject to an undisclosed financial encumbrance.
- Vehicles recorded as a statutory write-off on a written-off vehicle register.
- Repairable write-offs that haven’t been repaired, inspected, and re-registered as your state or territory requires.
- Non-vehicle items (parts, accessories, trailers) — these are outside our current scope.
- Vehicles on behalf of an unlicensed dealer if you are acting as an agent in a commercial capacity that requires a dealer licence.
Fees
Free listings carry no listing fee. Current Premium listing fees and dealer plan prices are published on our pricing page. Fees may change from time to time. We will announce a change on your dashboard and the Pricing page when it takes effect, and it never affects a listing you have already paid for.
All fees are quoted in Australian dollars. Carified isn’t registered for GST, so no GST is charged. Payments are processed securely through our payment provider. We do not store your full card details.
Once a listing is published, its listing fee isn’t refundable if you change your mind, sell the car, or the listing ends. If we remove a paid listing for a reason that isn’t a breach on your part, we will refund its listing fee. More on paid services is in our Terms of Service, and dealer plans are covered by the Dealer Agreement. Nothing in this agreement excludes your rights under the Australian Consumer Law.
Seller Conduct
As a seller, you agree to:
- Respond to genuine buyer enquiries in a timely and honest manner.
- Make the vehicle available for a pre-purchase inspection if requested by a serious buyer.
- Mark your listing as sold promptly once the vehicle has sold.
- Contact us via the Support page or at support@carified.com.au promptly if the vehicle is no longer available for any other reason, so the listing can be taken down. If our staff listed the car for you, you can also use the Take My Listing Down link in any email we sent you about it.
- Not engage in price manipulation or other deceptive practices.
- Treat all prospective buyers with respect and without discrimination.
Completing a Sale
Carified facilitates introductions between buyers and sellers but is not a party to the sale transaction. Once a buyer and seller agree to a sale, it is your responsibility as the seller to:
- Provide the buyer with a completed transfer of registration form and any documents required by the relevant state or territory road authority.
- Provide a receipt or contract of sale that accurately reflects the agreed price and vehicle details.
- Arrange a safe payment method. We strongly recommend bank transfer (EFT) or bank cheque. We advise against accepting cash for vehicles over $5,000.
- If the vehicle requires a roadworthy or safety certificate in your state or territory, ensure this is in place or clearly agreed upon in writing.
In Queensland, you must get a current safety certificate for a registered car before you hand it over, and give it to the buyer, plus a gas certificate under 3 months old if it runs on gas. Other states and territories have their own roadworthy and transfer rules. This is general guidance only — check with your state or territory road authority for what applies to you.
Once the sale is complete, mark the listing as sold and select the buyer from the users who messaged you about it, or record that the buyer isn’t on Carified. A buyer you select will be invited to confirm the purchase and can then leave a review. Offers made through Carified aren’t binding; the sale is the agreement you and the buyer make yourselves.
Representations & Warranties
By publishing a listing you represent and warrant that:
- You are the legal owner of the vehicle or are duly authorised to sell it.
- All information in the listing is accurate and not misleading.
- You have disclosed all known defects and modifications as required by this agreement.
- The vehicle is not stolen and has no altered or cloned VIN.
- Any documents you have attached to the listing are genuine.
- You are complying with all applicable laws, including the Australian Consumer Law and any state or territory laws governing the sale of motor vehicles.
Enforcement
If we reasonably believe that you have broken this agreement or the law, we may take any of the following actions:
- Issue a formal warning.
- Remove or suspend one or more listings.
- Temporarily or permanently suspend your account.
- Report the conduct to relevant authorities (police, ACCC, state fair trading agencies).
Where practical, we will tell you before or when we act, and give you the reason. We may act without notice where there is a risk to someone’s safety, a risk of fraud, or a legal reason not to tell you first. Refunds when we remove a paid listing or close an account are covered under Fees above and in our Terms of Service.
