Terms of Service

These terms govern your use of the Carified platform. Please read them carefully before using our services.

Last updated 15 Oct 202615 sections

The Key Points

  • You must be 18 or older and live in Australia.
  • Listings must be accurate, and you must be allowed to sell the car.
  • Reviews are public and can’t be edited. Fake or paid-for reviews are removed.
  • Prices are in AUD. Dealer plans renew monthly until the owner cancels.
  • Carified isn’t a party to the sale. Australian Consumer Law still applies.
  • Material changes are announced on your dashboard the day they take effect.

These points help you scan. The full text in each section is what applies.

Acceptance of Terms

By accessing or using Carified (“the Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.

These terms are a legally binding agreement between you and Carified (ABN 57 876 988 566) (“Carified”, “we”, “us”, or “our”). Carified is run by a sole trader, not a company.

If you open a dealership on Carified, or join a dealership’s team, our Dealer Agreement also applies. Where it differs from these terms on something about a dealership, the Dealer Agreement applies.

Eligibility

To use the Platform you must be at least 18 years of age and be a resident of Australia. By registering an account, you represent and warrant that you meet these requirements.

If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these terms, and all references to “you” include that entity.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately via the Support page or at support@carified.com.au if you suspect unauthorised access to your account.

You agree not to create multiple accounts, transfer your account to another person, or use another person’s account without their permission and our consent.

Listings

All vehicle listings must be accurate, complete, and compliant with Australian Consumer Law. Sellers are required to disclose all known defects, modifications, and relevant history, and to follow our Seller Agreement. By publishing a listing, you warrant that:

  • You are the legal owner of the vehicle or have authority to sell it.
  • All information provided, including photos, descriptions, and documents, is truthful and not misleading.
  • The vehicle is free of any undisclosed encumbrances or financial interests.
  • All documents you attach to the listing (such as service records and receipts) are genuine.

We may remove a listing where we reasonably believe it breaks these terms, the Seller Agreement, or the law. Where practical, we will tell you before or when we remove it, and give you the reason. If we remove a paid listing for a reason that isn’t a breach on your part, we will refund its listing fee.

Offers & Sales

Offers made through the Platform, and the replies to them (accepting, declining, or countering), are invitations to negotiate. They are not binding on the buyer or the seller, and accepting an offer on Carified does not create a contract of sale.

A sale only happens when the buyer and seller agree it between themselves, usually after the buyer has inspected the car. Carified is not a party to any sale, and does not hold or transfer payments between buyers and sellers.

Reviews

When a seller marks a car as sold, they record who bought it. Once that buyer confirms the purchase, they may leave a review of the seller, made up of a recommendation (recommended or not recommended), a written comment and, optionally, whether the car was as described. Only one review may be submitted per sale, and reviews cannot be edited or withdrawn once submitted. The seller may post one public reply to each review.

Reviews are displayed publicly against the seller’s profile alongside your name — they are not anonymous. A review of a car bought from a dealership is shown on the dealership’s storefront instead, and the dealership replies to it. By submitting a review, you grant Carified the licence described in the Intellectual Property section below to display it on the Platform.

Reviews must reflect your own genuine experience and must not contain false, defamatory, harassing, or otherwise unlawful content. Fake reviews, and reviews written or offered in exchange for payment, a discount, or any other incentive, are prohibited and will be removed, as will a sale recorded only to create one. We do not pre-screen or verify reviews and do not guarantee their accuracy, but we may remove a review or reply if we reasonably believe it breaches these terms. A removed review stays on the seller’s profile as a placeholder noting that Carified removed it.

Reminders & Guides

Garage reminders (such as registration, insurance, service, and parts & fluids reminders) are a convenience based on the dates and readings you enter. They may be late, missing, or wrong if those details are, and they don’t replace the renewal notices from your state or territory road authority or your insurer.

The handover checklist, its deadline reminder emails, and our other guides are general information to help you through a sale. They are not legal advice and are not a substitute for the requirements and notices of your state or territory road authority. Check with that authority if you’re unsure what applies to you.

Prohibited Conduct

You must not use the Platform to:

  • Post false, misleading, or fraudulent listings or communications.
  • Write, buy, or arrange fake or incentivised reviews.
  • Harass, threaten, or abuse other users.
  • Attempt to circumvent identity verification or any other security measures.
  • Scrape, harvest, or collect data from the Platform without our written consent.
  • Introduce malware, viruses, or any other harmful code to the Platform.
  • Conduct transactions off-platform to defraud another user.
  • Use the Platform for any unlawful purpose, including but not limited to money laundering or vehicle rebirthing.

Intellectual Property

All content on the Platform — including logos, design, text, and software — is owned by or licensed to Carified. You may not reproduce, distribute, or create derivative works without our prior written consent. Open-source software used on the Platform is listed, with its licences, on our Open-Source Licences page.

By uploading content (photos, documents, descriptions, reviews) to the Platform, you grant Carified a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for operating and promoting the Platform.

If you are a verified Dealer, you additionally grant Carified a non-exclusive, royalty-free licence to display your dealership’s name and logo on the Platform and in Carified’s own marketing materials (such as a partner showcase), for the purpose of promoting the Platform. This licence does not extend to any vehicle manufacturer’s own trademarks or branding, and does not imply endorsement of Carified by any manufacturer you represent. The dealership’s owner or a manager may withdraw the marketing part of this licence at any time from the Marketing card in the dealer dashboard’s Settings → General.

Vehicle make, model, generation, and engine data used on the Platform is sourced from vehicle-makes-models and is made available under the Open Database License (ODbL) 1.0.

Limitation of Liability

Carified is a marketplace and does not take part in transactions between buyers and sellers. We do not guarantee the accuracy of listings, the condition of vehicles, or the conduct of users.

To the maximum extent permitted by law, Carified will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any transaction conducted through it.

Nothing in these terms limits liability that cannot be excluded under Australian Consumer Law, including any applicable consumer guarantees.

Suspension & Closing Your Account

We may suspend or close your account, or limit what you can do on the Platform, if we reasonably believe you have broken these terms or the Seller Agreement, acted fraudulently or unlawfully, or put other users or the Platform at risk.

We will tell you when we act, and give you the reason, except where doing so would create a risk to someone’s safety, help fraud continue, or breach the law — in those cases we will tell you as soon as we reasonably can. While we look into a serious concern, we may suspend your account straight away for up to 7 days. If you think we’ve got it wrong, contact us and we will review the decision.

If we close your account, we will refund any fees you have prepaid for services you won’t receive, unless we closed it for a serious breach of these terms, such as fraud. A dealership’s plan is different: when it ends early, including when we revoke the dealership’s dealer status, refunds of the plan are governed by the Dealer Agreement, not this section.

You may close your account at any time from your account settings. If you own a dealership with a plan running, cancel it in the dealer dashboard’s Settings → Billing first; you can close your account once the month you’ve paid for has ended. Closing your account does not affect any obligations that arose before it closed. What happens to your information when you close your account is explained in our Privacy Policy.

Governing Law

Carified is run from South Australia and used across Australia: buyers and sellers can be in any state or territory, and so can the cars. These terms are governed by the laws of South Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia, and of any court that has jurisdiction where you live, for any dispute arising out of or in connection with these terms.

This doesn’t stop you from relying on the Australian Consumer Law or the consumer protection laws of the state or territory you live in, or from taking a complaint or claim to a court, tribunal, or consumer affairs agency there. The sale of a car between a buyer and a seller is also governed by the laws of the state or territory where it takes place, such as its registration transfer rules.

Changes to Terms

We may update these terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.

For a material change, we will post an announcement on your Carified dashboard on the day it takes effect, explaining what has changed.

If you don’t accept a change, you can stop using the Platform and close your account. If you do this within 30 days of the change and have prepaid for something you won’t then receive, we will refund the unused part. Changes to the Dealer Agreement, and refunds of a dealership’s plan when it ends because of a change, are governed by the Dealer Agreement.
